The Business Talent (Migrant) visa (Subclass 132)

Owners or part owners of overseas businesses with a genuine commitment to participate in the management of a new or existing business in Australia may be eligible for a Business Talent (Migrant) visa (Subclass 132). You will need to apply for sponsorship from a state or territory government.

This visa will allow you to:

  • Work in a new or existing business in Australia
  • Travel in and out of Australia any number of times during the validity period of the visa
  • Study in Australia
  • Have your family accompany you to Australia (they will have access to work and study rights)
  • Live in Australia as a permanent resident for five years (after those five years, you will need to apply for a resident return visa)

Am I eligible?

To be able to apply for this visa, you must:

  • Be less than 55 years old
  • Have an overall successful business career
  • Be sponsored by an appropriate regional authority of a state or territory government
  • Have net assets in a qualifying business of AU$400,000 for at least two of the four fiscal years immediately before you apply (you an your partner combined)
  • Have total assets with a net value of at least AU$1,500,000 that have been legally acquired and are capable of being transferred to Australia within two years of your visa being granted
  • Have a commitment to maintain an ownership interest in a business in Australia and direct and continuous involvement in the management of that business
  • Be of good health and character

What are my obligations?

After being granted the visa and arriving in Australia, you must either establish a qualifying business in the country or participate in an existing qualifying business. In that business, you must:

  • Maintain a substantial ownership
  • Maintain direct and continuous involvement in the day-to-day management of that business
  • Make decisions that affect the overall direction and performance of the business in a manner that benefits the Australian economy

Additionally, you must also notify the Department of Immigration and Citizenship (DIAC) of your residential address by completing the Form 922 within six months of your arrival in the country and fill out a survey of your business activity in Australia, using Form 1010.

How can I apply?

This application is a two-step process that starts with gaining sponsorship from the state or territory where you will go into business. After that, you will need to lodge your visa application with the DIAC, submitting the requested form and all required documentation.
